The Resident Labour Market Test (RLMT) ensures that the resident workforce (with the irrevocable right to work in the UK) do not miss out on jobs that suit them. There are exceptions where the RLMT does not need to be carried out (Please contact us to find out more about it).

Firstly, the employer will have to check if the job is skilled to an appropriate level, and if it is, whether or not that specific job role is paid at the appropriate rate as outlined in the duties and responsibilities section of the codes of practice.

The employer will then have to advertise that vacancy to the residence workforce for no less than 28 days through 2 different media, ranging from government job websites to national newspapers.

The company must set out the advert in a specific format and include specific information. If they don’t meet these requirements, they will fail the test and will have to do it all over again. This can be frustrating for the company as it is a waste of both time and money. It also delays the start date of the applicant’s employment and prolongs the gap in the company’s workforce.

Unfortunately the Home Office are not very flexible when it comes to near misses in the RLMT. Everything has to be pitch perfect. We have had employers coming to us and asking for help after they failed their RLMTs due to one tiny piece of missing detail.
